Himachal Pradesh High Court has dismissed the petition of B.Ed holders. The High Court has said that the recruitment of Shastri teachers in the state will be done without BEd educational qualification. The High Court has rejected the demand to make B.Ed compulsory in state. The division bench of Justice Tarlok Singh Chauhan and Justice Virendra Singh has given this decision. It was argued on behalf of BEd holder Satish Kumar and others that the state government has not made necessary amendments in the recruitment and promotion rules of Shastri teacher under the notification of NCTE. NCTE has issued a notification in the year 2011 and prescribed the mandatory qualification of B.Ed for Shastri teacher.
It was argued on behalf of the selected candidates that the notification of NCTE issued in the year 2011 is against the rules. NCTE has set the mandatory qualification of B.Ed for Shastri teacher on the recommendation of the Central Government, bypassing the rules. The Advocate General of the State Government had argued that the State Government is competent to determine the qualification of the teacher. The government has made the recruitment and promotion rules of Shastri teacher only under the notification of the year 2010 of NCTE.
After hearing the arguments of both the parties, the Bench in its decision said that under Sections 29(1) and 23(1) of the Right to Education Act, NCTE has the power to determine the minimum eligibility for a teacher. If the procedure as per rules is not followed while determining the eligibility, the State Government is not bound to follow the instructions issued by NCTE. The court observed that while prescribing B.Ed qualification for Shastri teacher, NCTE has violated Sections 3, 12 and 12A.
It is worth noting that the Selection Commission had advertised 1182 posts of Shastri teachers in the year 2020. These posts were to be filled by 50% batch wise and 50% by direct recruitment. Although out of this 582 posts have been filled by the department batch-wise, teachers have not yet been appointed on 582 posts to be filled by the commission. On December 23, 2021, the commission had declared the result of Shastri 813 Post Code.
